General Terms and Conditions

Between ANTICAFÉ & CO, limited company with a capital of EUR 1,358,283.70, located at 79, rue Quincampoix, 75003 Paris, registered with the PARIS Trade and Companies Registry under number 810 654 848 (hereinafter “ANTICAFÉ”),

On the one hand,

And the person or entity making the purchase and/or reservation of products or services of ANTICAFÉ, hereinafter, “The Customer”,

On the other hand,

It was outlined and agreed as follows:

Article 1: Purpose

The purpose of ANTICAFÉ is to operate a catering business with related services allowing immediate consumption on site through an original payment mechanism based mainly on consumption time, broken down into Services and Products, within ANTICAFÉ Spaces and under the ANTICAFÉ brand.

The present General Terms and Conditions determine the rights and obligations of the parties within the framework of the sale and/or online reservation of Products and services offered by ANTICAFÉ.

They are brought to the attention of any individual or legal entity wishing to make a purchase and/or reservation via the website http://anticafe.eu (hereinafter “the customer”) and set out the contractual provisions and conditions applicable to any purchase and/or reservation of goods and/or reservation of services made on this site.

The Client declares that he has read and accepted these general terms and conditions. Any order of goods and/or reservation of services on the website http://anticafe.eu implies the express agreement and the total and unreserved adherence of the Customer to these general terms and conditions, and, possibly, to the particular or specific conditions of one or more products or orders.

Article 2: General provisions

The present General Terms and Conditions apply to all reservations and/or sales of Products and Services made through ANTICAFÉ’s websites and are an integral part of the Contract between the Buyer and ANTICAFÉ.

ANTICAFÉ reserves the right to modify the present at any time, by publishing a new version on its website.

The applicable General Terms and Conditions are those in effect at the date of payment of the order by the customer.

The GTC can be consulted on the ANTICAFÉ website at the following address: http://anticafe.eu.

The customer declares to be able to contract legally under the French laws or validly represent the natural or legal person for which he commits themselves.

Article 3 : Description of services

The Services provided by ANTICAFÉ to the customer, directly or through its partners, consist of three distinct offers: the offer “table reservation”, the offer “room reservation” and the offer “privatization of a space”.

3.1 – “Table reservation” offer

The “table reservation” offer allows access, during the opening hours set and communicated by ANTICAFÉ, to a furnished, shared work space open to the public and common (“coworking space”).

The customer will be able to access this offer in all coworking spaces operated by ANTICAFÉ under the ANTICAFÉ brand.

The price of the “coworking” offer is fixed at €6 per hour and per person and includes, for the corresponding duration, all the following services:

– Individual access, within the limit of available places, to a nomadic work station, allocated according to availability upon arrival on site, consisting of a seat and a table ;
– Access to high-speed internet access by Wifi;
– Access to electrical outlets for recharging electrical appliances for work (computer, telephone…);
– Unlimited access to hot and cold drinks offered to clients of the coworking area and prepared on request by the Service Provider’s staff;
– Access to a self-service snack counter and/or snacks prepared on request by the Provider’s staff;
– Access to sanitary facilities;
– Cleaning and maintenance of the premises.

Subscription to this “coworking reservation” offer is made via the “table reservation” module available on the website http://anticafe.eu. The payment of the price corresponding to the reservation is made directly on the spot by the Client.

3.2 – “Room reservation” offer

The “room reservation” offer allows access, during opening hours set and communicated by ANTICAFÉ, to a private work space, furnished, closed and guaranteeing the confidentiality of exchanges, within the coworking space open to the public, operated by ANTICAFE, under the ANTICAFÉ brand (“coworking space”).

The customer will be able to access this offer in all coworking spaces operated by ANTICAFÉ under the ANTICAFÉ brand.

The price of the “room reservation” offer is fixed by the hour and includes, for the corresponding duration, all of the following services:

– Individual or group access, within the limit of the authorized capacity of the room concerned, to a private and closed room, guaranteeing the confidentiality of exchanges, and furnished with table and chairs;
– Access to high-speed internet access by Wifi;
– Access to electrical sockets for recharging electrical appliances for work (computer, telephone, etc.);
– Unlimited access to hot and cold drinks offered to clients of the coworking area and prepared on request by the Service Provider’s staff;
– Access to a self-service snack counter and/or snacks prepared on request by the Provider’s staff;
– Access to sanitary facilities;
– Cleaning and maintenance of the premises.

The subscription to this “room reservation” offer is made via the “room reservation” module available on the website http://anticafe.eu. The payment of the price corresponding to the reservation is made directly on the spot by the Customer.

3.3 – “Room privatization” offer

The offer “privatization of a space” allows the reservation, for a date, a number of participants and a duration previously agreed between the customer and ANTICAFÉ, of private work spaces within the coworking space operated by ANTICAFE, under the ANTICAFÉ brand.

The privatization of the different spaces can be done according to three formats of events :
– Full day (for a total duration of 8 hours)
– Half day (for a total of 4 hours)
– 2-hour meeting

For all sizes and/or duration of events, the offer provides, for the privatization private spaces :

– Access to a private and closed space, guaranteeing the confidentiality of exchanges;
– The supply of furniture (tables and chairs) in sufficient number for all participants of the event;
– The installation and prior arrangement of furniture and equipment according to the terms agreed between the Client and ANTICAFÉ (seating configuration, “theatre”, cocktail…).
– The provision of technical equipment (flip charts, screen, video projector, microphones and speakers) according to the terms previously agreed between the customer and ANTICAFÉ;
– Access to high speed internet in Wifi;
– Unlimited access to hot and cold drinks offered to customers in the coworking area and prepared on request by ANTICAFE staff;
– Access to a self-service snack counter and/or prepared on demand by ANTICAFÉ staff;
– Access to sanitary facilities;
– Cleaning and maintenance of the premises.

The offer also provides the possibility of access, upon prior request, quotation and agreement between the customer and ANTICAFÉ, to additional services, including but not limited to the following:

– Access to a catering service in the form of meal trays and/or a buffet
– Various activities and animations

The subscription by the customer to the offer “privatization of a space” is made by prior contact with the sales teams of ANTICAFE, through a contact form available on the site http://anticafe.eu, making and acceptance of a quote taking into account the specifics of the event.

It is finally agreed between the customer and ANTICAFÉ that the services provided as part of the offer “privatization of a space” will be subject to negotiated rates.

Article 4: Order and reservation

4.1 – Creation of the user space

The creation of the user space is done through a form accessible on the website http://anticafe.eu.
The data collected for the creation of the Customer’s user space are as follows: Last name, first name, e-mail address, telephone number and postal code.
The collection and processing of this data is carried out in compliance with legal and regulatory provisions, and within the strict framework specified in Article 8 of these general terms and conditions.

At any time, the Customer has the option of modifying this information and/or deleting his user space.

4.2 – Reservations

For the “table reservation” and “room reservation” offers, the Customer provides the following information:
Last name, first name, e-mail address, telephone and postal code.
The collection and processing of this data is carried out in compliance with legal and regulatory provisions, and within the strict framework specified in Article 8 of these general terms and conditions of sale.

The Client then chooses the date and place of the reservation, as well as the options offered, if any.

The Client then checks the details of the order and the price of the reservation.

To finalize the reservation, the Customer must click on a “confirm reservation” button.

The reservation of services is made for a specific day and time, and is only valid for that time slot.

The reservation is made within the limit of available seats, which are updated in real time on the website.

The reservation will be firm and final only after the customer has received a confirmation e-mail from ANTICAFÉ.

4.3 – Purchase and use of prepaid credits (“LE PASS” offer)

For the subscription of the offers “table reservation” and “room reservation”, the customer may use the purchase of prepaid credits on the site of ANTICAFÉ.

The access by the customer to his user space allows them to subscribe to the “prepaid credits” offer. These credits are payable immediately online on the http://anticafe.eu website.

The prepaid credits purchased by the customer can be used directly on the http://anticafe.eu website for the payment of the “table reservation” and/or “room reservation” offers.

Article 5: Price – Payment

The prices indicated by ANTICAFÉ are in euros, all taxes included, taking into account the VAT applicable on the day of the order, any change in the rate may be reflected in the price of products and services.

ANTICAFÉ reserves the right to modify the prices on its website at any time.
In all cases, the order of goods and/or services will be invoiced on the basis of the rates in force and mentioned on the site at the time of purchase or reservation.

Article 6: Retention of title clause

The products remain the property of ANTICAFÉ until full payment of the price by the customer.

Article 7 : Withdrawal and Cancellation

7.1 – Table or room reservation

According to article 221-28 of the French Consumer Code, no refund will be made in the event of total or partial cancellation of the reservation of the service by the client.

7.2 – Purchase of prepaid credits ” LE PASS “

For purchases of prepaid credits, in accordance with the provisions of Article L.121-21 of the Consumer Code, in the case of distance selling, the customer has a withdrawal period of 14 days from receipt of the gift voucher without having to justify the reasons or pay any penalties. Customers wishing to exercise their right of withdrawal can simply send an email to the following address: retractation@anticafe.fr.

Article 8: Protection of personal data

By purchasing or reserving products and/or services through the website of ANTICAFÉ, the customer consents to the collection of personal data necessary to ensure the proper processing of orders.

ANTICAFÉ commits to never communicate this information to third parties except in cases provided by law.

In accordance with the law of January 6, 1978 relating to data processing, the files and freedoms and with article 43 of the law of September 30, 1986 modified, this website was the subject of a declaration to the National Commission of Data processing and Freedoms (CNIL), which delivered a receipt.

The customer has the right to access, modify, rectify and delete data concerning him/her (art. 34 of the French law “Informatique et libertés” of 6 January 1978).

To exercise this right, please contact ANTICAFE by mail addressed to the head office.

In accordance with Articles L.223-1 and following of the Consumer Code, if the customer no longer wishes to be canvassed by telephone on the number he had given to ANTICAFE, he may at any time register this telephone number on the list of opposition to telephone canvassing by Internet on the site www.bloctel.gouv.fr or by mail by writing to : Company Opposetel, Service Bloctel, 6 rue Nicolas Siret 10000 Troyes.

This registration is free and valid for three years. However, ANTICAFÉ may contact by telephone the customer who has expressly requested it, during a period freely set by the customer or, failing that, within 3 months from the date of the customer’s request.

Article 9 : Property

The brands, domain names, products, software, images, videos, texts or more generally any information or content of the site anticafe.eu are and remain the exclusive property of ANTICAFÉ. No transfer of intellectual property rights is carried out through the present General Terms and Conditions.

Any total or partial reproduction, modification or use of these goods for any reason whatsoever is strictly prohibited.

Article 10 : Case of emergency

The performance of ANTICAFÉ’s obligations under the present contract shall be suspended in the event of the occurrence of an act of God or force majeure that would prevent its execution.

ANTICAFÉ will notify the customer of the occurrence of such an event as soon as possible.

Article 11: Applicable law and attribution of jurisdiction

The present general terms and conditions are subject to French law.
In case of dispute, the French courts have exclusive jurisdiction.

The present general terms and conditions are in force as of 13 May 2020.
